1. Freight cost
The freight cost for international deliveries is based on the volume of the order and decided by our shipping company. The freight cost will be added to the invoice if you do not choose to use your own transport company. Please contact us for more information about overseas freight costs.
2. Applicability
These general delivery regulations shall be applied when the parties have agreed to this. Deviations from these regulations shall be agreed upon in writing to become effective.
3. Order conditions
Temporarily sold-out items, and items with a later delivery date will be placed on a new order for a later date of delivery, according to agreement. Freight will be added. Order confirmation will be sent.
4. Delivery
Delivery of the goods takes place with a carrier selected by the seller. Delivery shall take place within the agreed delivery time. If no delivery time has been agreed upon, the delivery must take place without unreasonable delay. If no delivery clause has been specifically agreed upon, delivery shall take place “Ex Works”. Delivery clauses must be interpreted in accordance with the INCOTERMS applicable at the time of the agreement.
5. Payment
If the buyer is a new customer, the first delivery takes place after advance payment. After agreement between both parties, credit can be provided. If the buyer does not pay on time, the seller is entitled to interest on late payment from the due date with an interest rate corresponding to the reference interest rate applicable at any time with an addition of 10%.
6. Delayed payment and failure to pay
If the buyer is more than four weeks late with payment, this shall be considered a material breach of contract, which gives the seller the right to cancel the contract, reclaim the goods and claim damages. In the event of cancellation by the seller, the buyer must, unless otherwise agreed, immediately return the goods to the seller at his/her own expense and risk. Information about the failure to pay will be provided to the other members of the Gift Wholesalers’ Association (Presentgrossisternas Förening).
7. Terms of ownership
The goods will remain the seller’s property until full payment has been made. If it can be assumed that the buyer will not legally fulfil his/her obligations according to the agreement, or if the seller cancels the agreement, the seller has the right to repossess such goods that can be legally taken back. Before the goods have been paid in full, the buyer has no right to dispose of the goods in such a way that the seller’s right of repossession is jeopardized, without the written consent of the seller.
8. Complaints
Visible damage or deficiency, which can be assumed to have occurred during transport and which is discovered upon arrival of the goods, must, if the goods are acknowledged on a waybill or other shipping document, be reported immediately to the carrier by noting that on the shipping document. The recipient must immediately check whether the foods have hidden damages and report this to the carrier as soon as possible, however, no later than 7 days after the goods’ arrival. In addition, the seller must always be notified. Errors or deficiencies must be reported to the seller within 10 working days after the error or deficiency is discovered or should be discovered. The complaint must be made in writing with a picture and contain information about the nature and approximate extent of the error or deficiency. Damaged goods must be kept available for the seller’s inspection. If the buyer does not report the complaint in the prescribed manner within the prescribed period even though he/she has discovered or should have discovered the error or deficiency, he/she loses the right to make a claim because of this. In the event of an agreed return, the item must be returned in full in its original packaging and must not be marked with a price.
9. Limitation of Liability Terms
A Lot Decoration Sweden AB does not reimburse indirect costs that may arise in the event of wrong deliveries, delays, defective products or the like.
10. Dispute
Disputes due to the agreement or which are related to the agreement must be settled by a Swedish court in accordance with Swedish law.
11. Debiting
Upon delivery, the goods must be received in person. Debiting occurs if the shipping company cannot deliver the goods. Make sure to notify us in case of absence, to avoid being charged.
